TERMS & CONDITIONS


1. About Off Duty Jobs
Off Duty Jobs (“ODJ,” “we,” “us,” or “our”) provides moving and labor services, furniture assembly/disassembly, and certain home-safety-related services (e.g., dryer vent cleaning and smoke/CO detector replacement) to customers in Middle Tennessee and surrounding areas.
These Terms & Conditions (“Terms”) govern all services we provide. If a written estimate, work order, or invoice conflicts with these Terms, the written document controls only as to the conflicting item(s), and these Terms otherwise remain in effect.


2. Acceptance and Contract Formation
By scheduling services, submitting an intake form, requesting a quote, making a deposit or payment, signing (physically or electronically) any work order, or allowing ODJ to begin work, you agree to be bound by these Terms and represent that you have authority to do so.


3. Scope of Services; What We Do Not Provide
Our services may include:
Local residential and commercial moving (where offered).
Labor-only services (e.g., loading/unloading PODs, trucks, or trailers where the customer provides transportation).
Furniture assembly/disassembly for residential, commercial, and project-based work (including STR setups and new construction punch-list labor).

Dryer vent cleaning and smoke/CO detector replacement (as a convenience service).
We do not provide (unless expressly agreed in writing):
Long-distance or interstate household-goods transportation.
Certified fire inspections, building code compliance services, or any licensed fire-protection contracting services.
Structural engineering assessments, rigging, or specialty hauling unless explicitly quoted.
Packing services or materials unless explicitly included in writing.


4. Scheduling, Estimates, and Changes in Scope
Quotes are based on the information you provide (including the intake form inventory, access conditions, and service location details). If the scope, inventory, locations, or access conditions differ from what was disclosed, pricing and timing may change, and we may decline to move certain items for safety or practical reasons.
Common scope/access factors that can affect price or time include: stairs, elevators, long carries, narrow hallways, parking restrictions, multi-stop moves, oversized or specialty items (e.g., safes, pianos), fragile/high-value items, and disassembly required to safely move items.


5. Customer Responsibilities
To help us perform safely and efficiently, you agree to:
Provide accurate inventory and access details (including stairs, elevators, parking, and walk distances).
Ensure clear pathways and a reasonably safe working environment (including adequate lighting and stable floors).
Remove or secure tripping hazards, loose rugs, and fragile decor where feasible.
Secure pets and keep children and bystanders away from active work areas.
Notify ODJ of any changes before the scheduled service time.
Properly pack and seal boxes unless packing is included in writing.


6. Prohibited / Restricted Items
For safety and legal compliance, we may refuse to handle certain items, including:
Hazardous materials (flammables, explosives, corrosives, propane tanks, gasoline, ammunition, certain chemicals).
Live animals, perishable food requiring temperature control, or plants (unless agreed).
Items with suspected mold/infestation or biological hazards.
Items that are unsafe to move due to weight, condition, or access without special equipment.
You are responsible for properly disposing of prohibited items and for ensuring that no prohibited items are packed inside boxes or containers we handle.


7. Pricing, Deposits, and Payment
Unless otherwise stated in writing, pricing is billed on an hourly basis (including applicable travel time, minimums, or trip charges as quoted). Specialty items or services may incur additional charges. Payment is due upon completion of services unless we agree otherwise in writing.
Accepted payment methods may include cash, major credit/debit cards, Zelle, and check (subject to our approval). Returned payments may result in additional fees to the extent permitted by law.


8. Cancellations, Rescheduling, and Weather/Safety Delays
Cancellations made within 24 hours of the scheduled start time may incur a cancellation fee up to one hour of labor (or as otherwise stated in your written quote). Deposits (if collected) are refundable when cancellations occur more than 24 hours prior to service. If ODJ must cancel due to weather, safety, or personnel reasons, you may reschedule or receive a full refund of any deposit.


9. Damage Prevention; Condition of Items; Pre-Existing Issues
You are encouraged to identify fragile, high-value, or pre-damaged items before work begins and to document pre-existing damage. We are not responsible for:
Pre-existing damage, normal wear and tear, or latent defects.
Items packed by the customer, or boxes that are overloaded, unsealed, or structurally compromised.
Particle board/pressboard furniture, flat-pack items, or items that are structurally weak or previously repaired, to the extent damage results from their condition.
Damage resulting from customer-supplied equipment (e.g., rental trucks, ramps, dollies) or inadequate access conditions not disclosed in advance.


10. Claims Process (Notice and Opportunity to Inspect)
If you believe damage occurred during our services, you must notify us in writing as soon as reasonably possible, and in any event within 48 hours after service completion, so we have a fair opportunity to inspect and evaluate the claim. Please include photos and a brief description of the issue. Late reports may be denied if delay prejudices our ability to investigate.
At our option, and subject to applicable law, we may: (a) repair the item, (b) replace the item with a reasonably comparable item, or (c) compensate you for reasonable repair costs or the item’s fair market value, taking into account age and condition.


11. Dryer Vent Cleaning & Smoke/CO Detector Services Disclaimer
ODJ is not a licensed fire protection contractor and does not perform certified inspections. These services are intended to improve safety but do not guarantee elimination of fire risk, code compliance, or insurance qualification. You remain responsible for ongoing safety checks, maintenance, and functional testing of devices.


12. Limitation of Liability
To the fullest extent permitted by law:
ODJ is not liable for indirect, incidental, special, consequential, or punitive damages (including loss of use, lost profits/revenue, or sentimental value). ODJ’s total liability for any claim arising out of or relating to the services will not exceed the total fees you actually paid to ODJ for the specific job giving rise to the claim. Nothing in these Terms limits liability for gross negligence or willful misconduct to the extent such limitation is prohibited by applicable law.


13. Indemnity (Customer Responsibilities)
You agree to indemnify and hold ODJ harmless from third-party claims, damages, or expenses arising out of (a) your breach of these Terms, (b) prohibited items you provided, (c) unsafe conditions at the service location not disclosed in advance, or (d) instructions you direct us to follow that create unreasonable risk (e.g., moving overloaded boxes, moving items through unsafe pathways).


14. Photos, Video, and Testimonials (Optional)
With your permission, we may take before/after photos or brief video for quality control, training, and marketing. We will not intentionally capture sensitive personal information. You may opt out at any time by notifying us in writing before the job begins.


15. Dispute Resolution; Governing Law; Venue
If a dispute arises, the parties will first attempt to resolve it informally in good faith. Any legal action must be brought in the state or federal courts located in Tennessee, and the parties consent to personal jurisdiction and venue there. These Terms are governed by Tennessee law, without regard to conflict of law principles.


16. Modifications, Severability, and Entire Agreement
We may update these Terms from time to time by posting an updated version on our website with a revised effective date. The version in effect at the time you schedule services will apply to that job unless we mutually agree otherwise in writing. If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with any written quote/work order/invoice, constitute the entire agreement regarding the services.
